This Clarification Text has been issued by the Turkish Industry and Business Association (“TÜSİAD”), registered at Meşrutiyet Caddesi, No:46 Tepebaşı Istanbul, to provide you with information on such matters as the way in which your personal data is collected, processed, used, transferred and destroyed under the Law No. 6698 on the Protection of Personal Data (“Law No. 6698”) and other applicable regulations (hereinafter collectively referred to as “KVKK”), specifically within the scope of Article 10 titled “Obligation of Data Controller to Inform” and Article 11 titled “Rights of the Data Subject” regarding the processing of personal data.
Your personal data shall be processed by TÜSİAD to fulfill our obligations and commitments arising from relevant regulations regarding the personal information collected when you download the report named Türkiye: A Leading Hub for Startups and Tech Companies in EMEA report (the “Report”) through the website /https://www.entrepreneurshipturkiye.com (“Website”) and to inform you about the content added to the website. We exercise utmost care for the processing and protection of the personal data you share with us pursuant to Law No. 6698 and its subsequent regulations.
TÜSİAD shall process your personal data in line with the terms and purposes of processing personal data as prescribed the KVKK and as specified below:
– in compliance with applicable law and principles of integrity,
– by retaining the accuracy and the most up-to-date version of the personal data you disclose,
– for specific, explicit and lawful purposes,
– in a manner that is relevant, limited and proportionate to the purpose for which the data will be processed and
– as per the conditions and purposes stipulated in the relevant law or as necessary for the purpose for which they are processed.
This Clarification Text regarding the collection, processing and transfer of your personal data by TÜSİAD is intended to acquaint you with the following matters:
– The personal data which is collected and processed by TÜSİAD;
– The purpose for which TÜSİAD collects and processes your personal data,
– Persons with whom TÜSİAD shares your personal data,
– Whether your personal data is transferred outside Türkiye,
– How TÜSİAD stores and protects your data and
– The scope of your rights regarding your personal data.
For the purposes of this Clarification Text,
– “Personal Data” refers to information relating to an identified or identifiable individual; and
– “Processing” refers to operations such as collection, consent withdrawal, access, use, sharing, storage and destruction regarding Personal Data.
- Purpose of Processing
TÜSİAD shall process your personal data through the information collected when downloading the report titled Türkiye: A Leading Hub for Startups and Tech Companies in EMEA report (your name, surname, e-mail address, country you live in, the institution you work for and the title you hold) for such purposes as analyzing the audience reached, to ensure that questions about the report are forwarded to us and to enable subscriptions the e-bulletin of the website, to fulfill our obligations and commitments arising from applicable regulations regarding personal information, and to update you about the content added to the website.
- Legal Basis
Your personal data relating to your name and surname, and your traffic data shall be processed since it is essential for the establishment or performance of the contract, for TÜSİAD to fulfill its legal obligations as the data controller, and for TÜSİAD to establish, exercise or protect a right within the scope of Article 5/2 (c), (ç), (e) of the Law No. 6698 on the Protection of Personal Data (“Law No. 6698”), respectively, and thus shall not be subject to your explicit consent. In this respect, we hereby inform you that you do not have the right to request the deletion of your personal data prior to the expiration of storage periods required by business and law.
However, you are automatically opted in to the communication network of the e-bulletin and websites of https://www.entrepreneurshipturkiye.com upon completion of the relevant form. During your subscription, you will receive e-bulletins and event announcements containing new content added to the website and information you may be interested in. Processing of your personal data regarding your name, surname, e-mail address, country of residence, organization you work for and any titles you hold for the purposes of sending e-bulletins, providing information about events and announcements, analyzing the target audience who downloaded the report and also communicating with you shall be deemed to be based on your explicit consent pursuant to Article 5/1 of Law No. 6698.
- Data Collection Method
TÜSİAD shall collect your information, first and foremost your traffic data, and your name, surname, e-mail address, your country of residence, the organization you work for and the title you hold, when you visit https://www.entrepreneurshipturkiye.com, through your willful entry of data in the download form at the time you download the Report. Such data is processed by TÜSİAD and stored on the servers owned by TÜSİAD.
In accordance with the Law No. 6698, the following personal data shall be processed by TÜSİAD in writing in electronic and physical environments in a limited and measured manner in accordance with the purposes described below, in accordance with the Law No. 6698 by automatic and non-automatic methods

- Transfer to Third Persons and Overseas
4.1. Transfer of Personal Data to Third Persons
As part of the responsibilities and legal obligations arising from the Constitution of the Republic of Türkiye and the legislation of the Republic of Türkiye, your personal data may under certain conditions be transferred and disclosed to law enforcement units, judicial authorities, relevant ministries and offices and, without limitation, to the relevant public institutions and organizations authorized by law in accordance with Article 5/2 (a) with reference to Article 8/2 of Law No. 6698.
- Protection and Deletion of Personal Data
TÜSİAD is obliged to take, to the maximum extent possible, all kinds of physical, technical and administrative measures to ensure an adequate level of security in order to prevent unlawful processing of your personal data and unauthorized access to your personal data and to ensure the protection of your personal data. Your personal data shall be retained for the period required for the processing purposes specified in this Clarification Text and, in all circumstances, for the statutory limitation periods specified in applicable regulations. Upon expiration of the foregoing periods, TÜSİAD shall delete, destroy or anonymize your personal data in accordance with the Personal Data Retention and Destruction Policy. As required by Law No. 6698, TÜSİAD shall immediately inform you and the Personal Data Protection Board in cases that necessitate it.
- Use of Cookies
We use first party analytical cookies on the Website and first party mandatory cookies that are strictly necessary for the functioning of the Website in order to understand and facilitate the use of the Website by our visitors. We do not process your personal data through these cookies. You may review our Cookie Policy for further information.
- Your Rights as the Data Subject
You may exercise your rights stated herein below by applying to TÜSİAD, the Data Controller, at any time within the scope of Article 11 of Law No. 6698. Accordingly, participants whose personal data is processed have the following rights:
– To learn whether his/her personal data is being processed,
– To request information regarding personal data processed, if any,
– To learn the purpose for which personal data is processed and whether this data is used in accordance with its purpose,
– To know the third parties to whom their personal data have been transferred, to request the correction of errors in their personal data and to request such correction from the relevant third party if it has been transferred,
– In the event that they revoke their explicit consent, to request the deletion, destruction or anonymization of the data processed and to request that this request be communicated to third parties if the transfer has been made,
– To object to any unfavorable outcome related to the person as a result of the processed data, and
– If any damage arises due to data processing contrary to the Law, they have the right to seek compensation for such damage in accordance with the law.
Your rights listed above are limited by law and can only be provided by us subject to certain conditions (Please refer to Articles 10 and 13 of Law No. 6698).
Such requests listed above may be forwarded in writing to Meşrutiyet Cad. No:46 Tepebaşı Istanbul or via e-mail at [email protected] at any time by using the e-mail address you shared in the application form. Should you believe that your personal data has been processed in violation of the applicable Law No. 6698, you are entitled to file a complaint with the personal data protection officer after your application is rejected by TÜSİAD or if you receive an unsatisfactory response or do not receive a timely response.
